If your Florida [auto insurance](https://riskado.com/insurance-terms/personal-auto-policy/) [lapsed](https://riskado.com/insurance-terms/lapse/), the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) can suspend your driver [license](https://riskado.com/insurance-terms/insurance-license/) and vehicle registration after sending you notice and a chance to be heard, under [Fla. Stat. § 324.0221 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.0221.html). Every owner of a vehicle registered in Florida must keep [property damage liability](https://riskado.com/insurance-terms/property-damage-liability/) and [personal injury protection](https://riskado.com/insurance-terms/personal-injury-protection/) (PIP) in force. Getting reinstated costs $150 the first time, $250 the second time and $500 for each later reinstatement within three years of the first, plus proof of new [coverage](https://riskado.com/insurance-terms/coverage/). A crash while uninsured adds separate obligations on top of that.

### Key takeaways

- **Required coverage**Property damage liability and personal injury protection on every Florida-registered vehicle.
- **What FLHSMV can do**Suspend your driver license and vehicle registration after notice and a chance to be heard.
- **Reinstatement fee**$150 the first time, $250 the second and $500 for each later reinstatement within three years of the first.
- **Proof**New coverage, shown on an FLHSMV-approved form and kept for two years.
- **After a crash**A separate crash case can add its own requirements.

## What to do tonight

Start by finding out where you stand, then fix the coverage, then answer the notice. In order:

1. Don't drive until FLHSMV shows your license and registration as valid.
2. Read the whole notice and write down the sanction type and case number.
3. Check your license status with [FLHSMV Driver License Check (opens in a new tab)](https://services.flhsmv.gov/DLCheck/).
4. Call a Florida-licensed agent or your insurer about the coverage and proof the notice requires.
5. Ask whether the insurer has sent the policy information to FLHSMV electronically.
6. Submit the proof and any fee through the channel FLHSMV names in the notice.
7. Keep receipts, confirmation numbers, the policy and the notice together.
8. If the car will stay uninsured because you sold it, stored it or stopped using it, surrender the plate through FLHSMV.

A new policy bought tonight protects you going forward, but it doesn't close a suspension that has already been issued. That takes the steps in the notice.

## What does Florida require on a registered vehicle?

Florida requires two coverages on a registered vehicle. Every owner or operator of a vehicle required to be registered in Florida must be able to pay at least $10,000 for damage to other people's property in one crash, under [Fla. Stat. § 324.022 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.022.html). An insurance policy with at least $10,000 of property damage liability meets that rule, and so does a policy with at least $30,000 of combined property damage and bodily injury liability. Owners and registrants must also keep personal injury protection in effect continuously throughout the registration period, under [Fla. Stat. § 627.733 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0600-0699/0627/Sections/0627.733.html). Our article on [Florida PIP insurance](https://riskado.com/florida-pip-insurance/) explains what that coverage pays.

Everything else, such as collision, comprehensive or uninsured motorist coverage, is optional under these sections. The full list of minimums is in our article on [Florida car insurance requirements](https://riskado.com/florida-car-insurance-requirements/).

You also have to carry proof while you drive. [Fla. Stat. § 316.646 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0316/Sections/0316.646.html) requires proper proof of the required security in your immediate possession whenever you operate the vehicle. The proof can be paper or electronic: an insurance card in FLHSMV's format, the policy, a binder, a certificate of insurance or other proof the department allows.

![An open glove compartment holding a folded document and a small flashlight](https://riskado.com/blog/florida-driving-without-insurance/proof.jpg)

Florida requires proof of PIP and property damage liability in your possession whenever you drive.

## How does FLHSMV find out about a lapse?

Your insurer tells it. Each insurer that writes PIP or property damage liability must report a cancellation or nonrenewal to FLHSMV within 10 days after the processing date or effective date, under [§ 324.0221 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.0221.html). The insurer also reports a new policy for a customer it didn't insure earlier that calendar year, within the same 10 days. Insurers must tell you in writing that a cancellation will be reported and that failing to keep PIP and property damage liability can cost you your registration and driving privileges.

FLHSMV keeps that data in its insurance database. When you or an office submits policy information that doesn't match the database, FLHSMV sends the insurer an electronic verification request, and the insurer has 30 days to reply, according to FLHSMV's [financial responsibility verification criteria (opens in a new tab)](https://www.flhsmv.gov/pdf/frmanual/reference-verification-requests.pdf). If the insurer doesn't answer, or answers with a denial, FLHSMV sends you a suspension notice.

Once a suspension notice goes out, you have to respond to it. An insurer's reporting transaction, such as a new policy, a reinstatement or an added vehicle, does not automatically close the suspension, according to the same FLHSMV criteria.

### From a lapse to a suspension notice

1. Cancellation or nonrenewalYour PIP or property damage liability policy ends.
2. Within 10 daysThe insurer reports the cancellation or nonrenewal to FLHSMV.
3. VerificationIf policy information you submit doesn't match the database, the insurer has 30 days to answer FLHSMV.
4. Suspension noticeNo answer or a denial leads FLHSMV to send a suspension notice.
5. ReinstatementYou respond to the notice, pay the $150, $250 or $500 fee and keep proof of coverage for two years.

## How many days can insurance lapse before Florida acts?

There is no set number of lapse days under [§ 324.0221 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.0221.html). FLHSMV can suspend when its records show that the required security was not in full force when it was required, or when an insurer reports a cancellation or termination. A lapse of a few days is still a lapse on the record.

Go by the notice in your hand and the status FLHSMV shows for your license and registration. If you believe you had coverage the whole time, ask your insurer to confirm what it reported and when.

## What does the FLHSMV notice mean?

The letter's code tells you why it was sent. FLHSMV describes these sanctions in its [verification criteria (opens in a new tab)](https://www.flhsmv.gov/pdf/frmanual/reference-verification-requests.pdf):

What Florida's FR7, FR8 and FR9 notices mean

Hover or tap a row to highlight it.

| Notice | When FLHSMV generates it |
| --- | --- |
| FR7 | An insurer files a policy cancellation and no other active policy is on the database for the vehicle |
| FR8 | Insurance given when the vehicle was registered or renewed can't be found, and the insurer denies coverage on verification |
| FR9 | A crash with property damage and no injuries, where PIP and property damage liability for the at-fault vehicle can't be found |

FLHSMV gives you an opportunity to prove you had coverage or to have an administrative hearing. When you receive the notice of suspension, you can request a hearing; otherwise, one won't be scheduled for you, according to the [FLHSMV Driver Handbook (opens in a new tab)](https://www.flhsmv.gov/pdf/handbooks/englishdriverhandbook.pdf).

## Will Florida suspend your license and registration?

Yes, both can be suspended. Under [§ 324.0221 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.0221.html), after due notice and an opportunity to be heard, FLHSMV suspends the registration and driver license of an owner or registrant whose vehicle didn't have the required security in force, or whose insurer reported a cancellation.

The length of a suspension depends on the sanction and the notice, so don't drive until FLHSMV confirms that the license is valid and the registration is clear. While a license or registration is suspended under Chapter 324, you must return it to FLHSMV, under [Fla. Stat. § 324.201 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.201.html).

Plate seizure is part of the same section. If an officer finds that the driver is also the owner or registrant and the license or registration has been suspended under Chapter 324 for at least 30 days, the officer must seize the license plate immediately.

![A license plate lying face down beside a screwdriver on a garage floor](https://riskado.com/blog/florida-driving-without-insurance/plate.jpg)

After 30 days of suspension under Chapter 324, an officer must seize the plate of an owner found driving.

## How much does reinstatement cost?

The fees are set in [§ 324.0221(3) (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.0221.html) and are nonrefundable:

| Reinstatement | Fee |
| --- | --- |
| First reinstatement | $150 |
| Second reinstatement | $250 |
| Each later reinstatement during the 3 years after the first | $500 |
| First reinstatement after 3 years with no second reinstatement | $150 |

If both your license and registration are suspended under [§ 324.0221 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.0221.html) or [§ 316.646 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0316/Sections/0316.646.html), you pay only one fee to reinstate both.

First reinstatement150

Second reinstatement250

Each later reinstatement within 3 years500

The fee is only part of reinstatement. You also have to get the coverage the sanction requires and present proof on an FLHSMV-approved form that it is in force, and that proof must be maintained for two years. Depending on the notice and the type of case, you complete the transaction through FLHSMV's online services, a driver license office, or a tax collector or motor vehicle service center.

## Is there a fine for driving without insurance in Florida?

Florida has no single "no insurance fine" that covers every situation. What you face depends on what happened:

- A citation if you're stopped without proof. For an owner or registrant driving the vehicle, failing to carry proof is a nonmoving traffic infraction with the penalty set in Chapter 318, under [§ 316.646 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0316/Sections/0316.646.html). If you don't show the court by your appearance date that coverage was in effect at the time, a conviction leads to suspension of your registration and license.
- Suspension of your license and registration after an insurer reports a cancellation or FLHSMV finds no coverage.
- The reinstatement fee of $150, $250 or $500.
- Proof of the required coverage, kept for two years.
- Separate obligations after a crash.
- Plate seizure after 30 days of suspension, under the conditions in [§ 324.201 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.201.html).

## What happens after a crash while uninsured?

A crash brings in a second process. Thirty days after FLHSMV receives notice of a reportable crash, it suspends the operator's license and the owner's registrations, after notice and a chance to be heard, unless the person shows FLHSMV before then that an exemption applies, under [Fla. Stat. § 324.051 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.051.html). The exemptions include proof that:

- The vehicle was legally parked at the time of the crash.
- The vehicle was owned by the federal government, the state or a local government.
- Every injured party signed a written release from liability, and you have met one of the financial-responsibility methods in [§ 324.031 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.031.html).
- You deposited the security the statute requires, and you have met one of those methods.

FLHSMV's crash cases can call for proof of coverage on the crash date, releases for property damage you caused to others and the applicable reinstatement fee, according to FLHSMV's [insurance procedures manual (opens in a new tab)](https://www.flhsmv.gov/pdf/frmanual/ftp-procedure-manual.pdf). That is separate from the lapse process above, and a crash case can require an [SR-22 filing](https://riskado.com/florida-sr22-insurance/) before you can drive again.

If you hit a parked car, a note on the windshield doesn't take the place of insurance, proof or Florida's crash-reporting duties. Exchange the required information, report the crash where the law requires it, keep photos and records, and follow any FLHSMV notice that arrives.

![Two cars pulled onto a highway shoulder after a minor collision on an overcast day](https://riskado.com/blog/florida-driving-without-insurance/crash.jpg)

A crash while uninsured opens a separate FLHSMV case with its own 30-day clock.

## Can police tow the car, or can you go to jail?

The consequences written into Florida's financial-responsibility law for a lapse are proof requirements, suspension, reinstatement fees and, in the cases above, plate seizure. Criminal charges attach to separate acts:

- Showing an officer proof of insurance you know isn't in force is a first-degree misdemeanor, under [§ 316.646(4) (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0316/Sections/0316.646.html).
- Failing to return a suspended license or registration to FLHSMV can lead to a warrant charging a second-degree misdemeanor, under [§ 324.201(1) (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.201.html).
- Making a false statement on a required notice, or a false affidavit in a registration transfer, is a second-degree misdemeanor, under [Fla. Stat. § 324.221 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.221.html).
- Driving with a suspended license can mean jail. The [FLHSMV Driver Handbook (opens in a new tab)](https://www.flhsmv.gov/pdf/handbooks/englishdriverhandbook.pdf) warns that an officer may take you to jail for it.

That last point is why the first step tonight is to stay off the road until your status is clear. If your car was towed after a stop, ask the law enforcement agency what the tow was for and whether another offense was involved.

## What if you sold or stored the car?

Turn in the plate before you cancel the insurance. When your insurance is canceled or expires, failing to surrender a valid plate will result in suspension of your driver license, according to FLHSMV's page on [license plates and registration (opens in a new tab)](https://www.flhsmv.gov/motor-vehicles-tags-titles/license-plates-registration/). You can surrender the plate at a tax collector's office or motor vehicle service center, or by mail as FLHSMV directs, and the receipt shows the plate was turned in.

PIP and property damage liability must be kept continuously during the registration period, as FLHSMV's [license plate brochure (opens in a new tab)](https://www.flhsmv.gov/pdf/specialtyplates/tagbrochure.pdf) explains under [Fla. Stat. § 320.02 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0320/Sections/0320.02.html) and § 627.733. A car sitting in a garage with an active plate still needs coverage.

![A car under a fitted cloth cover in a tidy home garage](https://riskado.com/blog/florida-driving-without-insurance/stored-car.jpg)

A stored car with an active plate still needs PIP and property damage liability, so surrender the plate first.

## Where can you get official help in Spanish?

The Florida Department of Financial Services (DFS) publishes its automobile insurance toolkit, automobile claim guide and mediation materials in English and Spanish on its [consumer guides page (opens in a new tab)](https://www.myfloridacfo.com/division/consumers/understanding-insurance/guides), including the [Spanish automobile insurance guide (opens in a new tab)](https://www.myfloridacfo.com/docs-sf/insurance-consumer-advocate-libraries/ica-documents/applying-for-automobile-insurance-spanish.pdf). FLHSMV offers Spanish-language driver license and motor vehicle information on its [Spanish official-resources page (opens in a new tab)](https://www.flhsmv.gov/2019/03/06/FLHSMV-urges-customers-to-use-official-resources-for-driver-license-and-motor-vehicle-services-es/).

For help with a specific notice, ask the agency that sent it for language assistance, or call the DFS helpline below.

## How do you check an agent or make a complaint?

Make sure an agent is licensed in Florida before you buy, as DFS advises on its [purchasing insurance page (opens in a new tab)](https://www.myfloridacfo.com/division/consumers/purchasinginsurance/). Use the [Florida insurance license lookup (opens in a new tab)](https://licenseesearch.fldfs.com/) to search by the agent's name.

For a problem with an insurer or agent, contact the [DFS Division of Consumer Services (opens in a new tab)](https://www.myfloridacfo.com/division/consumers/) or the Florida Insurance Consumer Helpline at 1-877-693-5236. A suspension notice or a traffic ticket stays with the agency named on it, which is usually FLHSMV or the court. DFS can help with the insurance side, but it doesn't replace those processes.

## Questions to ask before you buy or renew

- What coverage is required for this vehicle and registration?
- When will the policy take effect?
- Does the policy list the right vehicle identification number and every required driver?
- What proof of insurance will I get?
- Will the insurer report the policy to FLHSMV electronically?
- If I'm using this policy to clear a sanction, what exact coverage does my notice require?
- Does the sanction require coverage that can't be canceled, or continued proof for a set period?
- What happens if the policy is canceled or nonrenewed?
- Who handles a reporting error or a verification denial?
- Are you licensed in Florida?
- What are the policy's exclusions, deductibles and cancellation terms?

Answer the application accurately, review it before you sign and list every licensed driver in your household, as DFS advises. Riskado's directory lists [insurance agencies in Florida](https://riskado.com/agencies/florida/) by city and by category if you need a local agency to call.

## Frequently asked questions

### How long can insurance lapse in Florida before suspension?

There is no grace period measured in days under [§ 324.0221 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.0221.html). FLHSMV acts on its records and on the insurer's cancellation report, which is due within 10 days. Follow your notice and check your status with FLHSMV.

### Does buying a new policy clear my suspension?

Not by itself. An insurer's new-policy transaction doesn't automatically close a suspension, according to FLHSMV's [verification criteria (opens in a new tab)](https://www.flhsmv.gov/pdf/frmanual/reference-verification-requests.pdf). You still respond to the notice, pay the reinstatement fee and present the proof FLHSMV requires.

### Do I pay two fees if my license and registration are both suspended?

No. When both are suspended under [§ 324.0221 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.0221.html) or [§ 316.646 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0316/Sections/0316.646.html), one reinstatement fee reinstates both. The fee is $150, $250 or $500 depending on how many reinstatements you've had in the past three years.

### How long do I have to keep proof after reinstatement?

Two years. Under [§ 324.0221(3) (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.0221.html), the proof that your coverage is in force must be maintained for two years after you reinstate.

### What happens if I hit someone while uninsured?

FLHSMV starts a crash case and suspends your license and registrations 30 days after it receives notice of the crash, unless you show an exemption first, under [§ 324.051 (opens in a new tab)](https://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0300-0399/0324/Sections/0324.051.html). A written release from every injured party, combined with financial responsibility under § 324.031, is one of the ways out. The DUI-related [FR-44 filing](https://riskado.com/florida-fr44-insurance/) is a separate requirement with higher limits.

## Getting back on the road

Stay off the road until FLHSMV shows a valid license and a clear registration. Put the required PIP and property damage liability in place, answer the notice with the proof and the single reinstatement fee it calls for, and keep that proof for two years. If the car is leaving the road for good, surrender the plate before the insurance ends, so the next notice never arrives.
