# Gap insurance

[Auto](https://riskado.com/auto-insurance/) · Updated Oct 1, 2026

Gap insurance is optional coverage for a financed or leased vehicle that helps pay the difference between the vehicle's actual cash value and the remaining loan or lease balance after a covered total loss or qualifying theft. Its exclusions, deductible rules, limits and eligibility come from the policy or waiver contract.

Also called: gap coverage, guaranteed auto protection, gap

Gap insurance matters when a vehicle is worth less than the balance still owed on it. After a covered total loss or an unrecovered theft, the primary physical-damage [claim](https://riskado.com/insurance-terms/claim/) pays the vehicle's [actual cash value](https://riskado.com/insurance-terms/actual-cash-value/), and gap [coverage](https://riskado.com/insurance-terms/coverage/) pays the [excess](https://riskado.com/insurance-terms/excess-coverage/) of the debt over that payment, up to the [limits](https://riskado.com/insurance-terms/limit-of-liability/) in the contract, which is how the [NAIC glossary (opens in a new tab)](https://content.naic.org/glossary-insurance-terms) describes personal GAP insurance. It does not apply to ordinary repairs, and the [policyholder](https://riskado.com/insurance-terms/policyholder/) still needs primary physical-damage coverage.

## How the payout works after a total loss

Take a new vehicle with a $30,000 loan balance and an actual cash value of $25,000 at the time of the accident. The primary insurer pays $25,000, less the deductible, and gap coverage pays the remaining $5,000, which leaves a $0 loan balance, according to the [Washington Office of the Insurance Commissioner (opens in a new tab)](https://www.insurance.wa.gov/insurance-resources/auto-insurance/how-auto-insurance-works/gap-insurance).

Gap payout in a $30,000 loan example

Hover or tap a row to highlight it.

| Item | Amount |
| --- | --- |
| Loan balance | $30,000 |
| Actual cash value at the time of the accident | $25,000 |
| Primary insurer payment, before any deductible | $25,000 |
| Gap amount ($30,000 minus $25,000) | $5,000 |
| Loan balance after gap payment | $0 |

A deductible lowers the primary payment. With a hypothetical $1,000 deductible in the same example, the primary insurer would pay $24,000 and $6,000 would remain before any gap payment. Whether gap coverage picks up that deductible depends on the policy, and the [Nevada Division of Insurance (opens in a new tab)](https://doi.nv.gov/Consumers/Automobile-Insurance/Gap-Insurance/) says some GAP policies cover it.

Lender interest, late fees and missed payments are not covered, according to the [Washington Office of the Insurance Commissioner (opens in a new tab)](https://www.insurance.wa.gov/insurance-resources/auto-insurance/how-auto-insurance-works/gap-insurance). A specific contract can also exclude negative equity, prior loan balances, service contracts and extended warranties.

## Types of gap protection and what each changes

The form of the product decides who is protected, which events qualify and how cancellation works.

- **Insurer endorsement or separate policy.** The insurer pays the covered difference after the primary claim, subject to the endorsement's eligibility rules, exclusions, deductible treatment, duration and maximum benefit, and the premium is added to the auto policy, according to the [New York Department of Financial Services (opens in a new tab)](https://www.dfs.ny.gov/consumers/auto_insurance/Auto_resource_center).
- **Lender, dealer or lessor waiver.** A creditor agrees to cancel some or all of the remaining debt after a total loss or unrecovered theft. A debt waiver is not insurance, under [Conn. Gen. Stat. § 36a-789 (opens in a new tab)](https://www.cga.ct.gov/current/pub/chap_669.htm#sec_36a-789).
- **Eligibility by vehicle age.** Loan gap coverage is available on new vehicles only in California, according to the [California Department of Insurance (opens in a new tab)](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/01-auto/autoterms.cfm). Other states and products set their own rules.
- **Time limits and price.** Add-on products can apply only for specific periods, such as four years, and the price varies greatly, according to the [CFPB (opens in a new tab)](https://www.consumerfinance.gov/ask-cfpb/what-is-guaranteed-asset-protection-gap-insurance-en-797/). Financing the charge into the loan adds interest.

## Where you will see gap coverage

On an auto quote, the product appears as "GAP," "gap coverage," "loan/lease gap coverage" or "loan payoff coverage," and some sellers use the label "guaranteed auto protection." The declarations page lists selected coverages, limits, deductibles and covered vehicles, and the attached endorsement or the lender's contract holds the gap terms, according to the [NAIC (opens in a new tab)](https://content.naic.org/consumer/auto-insurance.htm). A retail installment contract, a lease, a renewal notice and the claim letter after a total loss are the other places to look.

"[Full coverage](https://riskado.com/insurance-terms/full-coverage/)" is an informal phrase for liability plus collision and comprehensive coverage, and [collision coverage](https://riskado.com/insurance-terms/collision-coverage/) and [comprehensive coverage](https://riskado.com/insurance-terms/comprehensive-coverage/) pay up to the vehicle's actual cash value, not the loan balance.

## What Connecticut and New York law change

In Connecticut, the charge for a waiver must be separately stated and is not a finance charge or interest. A borrower who cancels after the sixtieth day, or whose loan or lease ends early with no benefits provided, is entitled to a pro rata refund, less any cancellation fee the waiver allows, under [Conn. Gen. Stat. § 36a-789 (opens in a new tab)](https://www.cga.ct.gov/current/pub/chap_669.htm#sec_36a-789). The rule covers agreements entered into on or after January 1, 2024.

In New York, a separate notice is required before a retail installment contract is signed when the buyer stays responsible for the gap amount, under [N.Y. Personal Property Law § 302-A (opens in a new tab)](https://www.nysenate.gov/legislation/laws/PEP/302-A). The holder must offer a waiver when creditor gap insurance is available from a New York-authorized insurer, and the contract cannot be conditioned on the buyer obtaining debtor gap insurance. [N.Y. Insurance Law § 1113(a)(26) (opens in a new tab)](https://www.nysenate.gov/legislation/laws/ISC/1113) separates creditor gap insurance from debtor gap insurance.

## Questions to ask an agent, insurer or lender

1. Is this an insurance policy, an endorsement or a creditor debt waiver, and does it cover a loan, a lease or both? The answer sets who receives the benefit and which cancellation and refund rules apply.
2. How is the payable gap calculated, and which loan charges are excluded? The contract defines the figures that count.
3. Does the benefit cover my deductible, and is there a maximum dollar or loan-to-value limit? A cap can leave part of the shortfall unpaid.
4. When does coverage end, and what happens if I sell, refinance or prepay? Early payoff can create refund rights.
5. What documents are needed after a total loss, and who receives the payment? The payment can go to the lender and be applied to the debt.

## Frequently asked questions

These answers apply to a financed or leased vehicle.

### Does gap insurance pay off a car loan after an accident?

Only after a qualifying total loss, and only for the covered difference between the primary insurer's payment and the loan balance. If the vehicle is repairable, gap coverage normally does not apply.

### Do I need gap insurance if I have full coverage?

Collision and comprehensive coverage pay the vehicle's value, not a larger loan balance. When the claim payment falls below the loan balance, the lender can expect the borrower to pay the deficiency, according to the [California Department of Insurance (opens in a new tab)](https://www.insurance.ca.gov/01-consumers/105-type/95-guides/01-auto/hadaccident.cfm).

### Is gap insurance required by law?

Connecticut does not require a general gap purchase, and New York does not generally require a consumer to buy debtor gap insurance. The [Nevada Division of Insurance (opens in a new tab)](https://doi.nv.gov/Consumers/Automobile-Insurance/Gap-Insurance/) describes the product as optional, although some finance companies require it for certain loans, so the loan or lease contract is the place to check.

### Can I cancel gap coverage after paying off my car?

After payoff, sale or refinancing, the product no longer serves its purpose on that loan. The [CFPB (opens in a new tab)](https://www.consumerfinance.gov/ask-cfpb/what-is-guaranteed-asset-protection-gap-insurance-en-797/) says a consumer may be entitled to a refund for an unused optional add-on, so ask the provider or lender for the cancellation terms in writing.
