A Maine [SR-22](https://riskado.com/insurance-terms/sr-22/) is a certificate your [insurance company](https://riskado.com/insurance-terms/insurer/) files with the Bureau of Motor Vehicles to show you carry qualifying [auto insurance](https://riskado.com/insurance-terms/personal-auto-policy/), according to the [Maine Bureau of Insurance (opens in a new tab)](https://www1.maine.gov/pfr/insurance/frequently-asked-questions/auto-insurance). Maine can require this proof after certain motor vehicle convictions or adjudications, a repeat OUI conviction, an accident, an unpaid judgment, or an out-of-state conviction. After a conviction or adjudication and reinstatement, you must keep proof of [financial responsibility](https://riskado.com/insurance-terms/minimum-coverage/) in place for at least three years under [29-A M.R.S. § 1603 (opens in a new tab)](https://www.legislature.maine.gov/legis/statutes/29-A/title29-Asec1603.html). Your written BMV notice sets the exact requirement in your case, and the BMV accepts an SR-22 only from an insurer licensed to sell insurance in Maine.

### Key takeaways

- **What it is**A certificate your insurance company files with the BMV to show you carry qualifying auto insurance.

- **Who can file**The BMV accepts an SR-22 only from an insurer licensed to sell insurance in Maine.

## What an SR-22 is, and what it is not

An SR-22 is a filing, not a separate kind of insurance. You buy a [qualifying auto policy](https://riskado.com/maine-car-insurance-requirements/), and the insurer sends the certificate to the Secretary of State or BMV on your behalf. You do not file the insurer's certificate yourself.

Maine law allows proof through a certificate from an insurance or surety company under [29-A M.R.S. § 1605 (opens in a new tab)](https://legisweb0.legislature.maine.gov/legis/statutes/29-A/title29-Asec1605.html), and [29-A M.R.S. § 1606 (opens in a new tab)](https://www.legislature.maine.gov/legis/statutes/29-A/title29-Asec1606.html) sets the policy form and the filing and [cancellation](https://riskado.com/insurance-terms/cancellation/) rules for a certified policy. The certificate does not add coverage. Your policy's limits, exclusions and [endorsements](https://riskado.com/insurance-terms/endorsement/) still decide what the insurance pays after a claim.

![A closed folder, a pen and a set of car keys on a desk beside a laptop with a dark screen](https://riskado.com/blog/maine-sr22-insurance/certificate-filing.jpg)

The insurer files the certificate; your policy still decides what the insurance pays.

## Start with your BMV notice

The written notice from the BMV is the most important document you have. It tells you whether you need an SR-22 or another form of proof, the effective date, and what you must do to reinstate. If you do not have a copy, the [BMV Financial Responsibility section (opens in a new tab)](https://www.maine.gov/sos/bmv/driver-licenses-and-ids/license-suspended/financial-responsibility) can send you a copy of the letter showing the requirement or judgment suspension for $5, plus $2 if you want it faxed.

Bring that notice to your insurance agent. It answers most of the questions an agent will ask, including which effective date the filing needs to show.

Your written BMV notice sets the requirement and the effective date.

## Why Maine might require an SR-22

Maine requires proof of financial responsibility in several situations under [29-A M.R.S. § 1603 (opens in a new tab)](https://www.legislature.maine.gov/legis/statutes/29-A/title29-Asec1603.html):

- **Motor vehicle violations other than OUI.** After a conviction or adjudication, the Secretary of State may suspend your license and registration until you provide proof.
- **Repeat OUI.** If you are convicted of OUI and had a previous OUI conviction within 10 years, the Secretary of State may not reinstate your license until proof is provided.
- **Out-of-state convictions.** The Secretary of State must act on proper evidence of a conviction or adjudication in another state.
- **Accidents.** After an accident, the Secretary of State may require proof for a specified period.
- **Unpaid judgments.** An unsatisfied judgment from a qualifying accident can lead to suspension until the judgment is resolved and proof is provided.

The common situations behind an SR-22 are an accident without insurance or a serious violation, according to the [Maine Bureau of Insurance (opens in a new tab)](https://www1.maine.gov/pfr/insurance/frequently-asked-questions/auto-insurance). A first OUI can involve its own separate suspension rules, so check your notice rather than assuming an SR-22 applies.

## How long you need an SR-22 in Maine

The minimum is three years. After a conviction or adjudication for a motor vehicle violation and reinstatement of your license and registration, you must maintain proof of financial responsibility for at least three years, under [29-A M.R.S. § 1603 (opens in a new tab)](https://www.legislature.maine.gov/legis/statutes/29-A/title29-Asec1603.html). The same section allows the Secretary of State to waive the demand after three years from the date the proof was demanded.

Those two dates can differ, which is why the start date matters. Your period can depend on the BMV demand, the underlying event, when you were reinstated, and any separate suspension or judgment rules. Ask the BMV to confirm your end date in writing before you drop the filing or switch insurers.

## Is there a nine-month rule in Maine?

The Maine statute that governs SR-22 periods sets a minimum of three years after conviction or adjudication and reinstatement, under [29-A M.R.S. § 1603 (opens in a new tab)](https://www.legislature.maine.gov/legis/statutes/29-A/title29-Asec1603.html). Treat your written BMV notice as the authority on your own period. If anyone tells you a nine-month period applies to you, ask the [BMV Financial Responsibility section (opens in a new tab)](https://www.maine.gov/sos/bmv/driver-licenses-and-ids/license-suspended/financial-responsibility) to confirm it in writing before you rely on it.

## How to get an SR-22 filed in Maine

The process runs in this order:

1. Get the BMV's written requirement or suspension information.
2. Give the notice and effective date to a licensed insurance producer.
3. Ask whether an insurer licensed to sell insurance in Maine will issue the policy and file the SR-22.
4. Confirm the policy's effective date and that the filing went to the BMV.
5. Pay the BMV reinstatement fee and complete any other steps listed on your notice.
6. Confirm with the BMV that the filing and reinstatement are complete before you drive.

The insurer has to be licensed in Maine. The BMV accepts an SR-22 only from a company licensed to sell insurance in Maine, according to the [Maine Bureau of Insurance (opens in a new tab)](https://www1.maine.gov/pfr/insurance/frequently-asked-questions/auto-insurance).

![A phone and a pen on a notepad with a short checklist of blank lines](https://riskado.com/blog/maine-sr22-insurance/filing-steps.jpg)

Confirm the filing and reinstatement with the BMV before you drive.

## What if you do not own a car?

A non-owner auto policy is one option for a driver who does not own a vehicle, according to [NAIC consumer guidance (opens in a new tab)](https://content.naic.org/consumer/auto-insurance.htm). Before you buy one, ask the insurer whether it will file the Maine certificate on that policy and confirm with the BMV that it satisfies your requirement.

## What the BMV fees look like

Reinstatement fees, fines and court fees must be paid before your license is reinstated, according to the [BMV suspensions and revocations page (opens in a new tab)](https://www1.maine.gov/sos/bmv/driver-licenses-and-ids/license-suspended/license-suspensions-revocations). The amount depends on the type of suspension and appears on your BMV notice or the payment service.

| Copy of the requirement or judgment suspension letter | $5 | [BMV Financial Responsibility (opens in a new tab)](https://www.maine.gov/sos/bmv/driver-licenses-and-ids/license-suspended/financial-responsibility) |
| Fax of that letter | $2 extra | [BMV Financial Responsibility (opens in a new tab)](https://www.maine.gov/sos/bmv/driver-licenses-and-ids/license-suspended/financial-responsibility) |

Your insurer may also charge for the filing or the policy. Ask the producer to itemize any SR-22 filing fee or policy fee before you buy.

## What happens if your SR-22 policy is canceled or lapses

A policy certified as proof of financial responsibility cannot be canceled until at least 10 days after notice of cancellation is filed with the Secretary of State, under [29-A M.R.S. § 1606 (opens in a new tab)](https://www.legislature.maine.gov/legis/statutes/29-A/title29-Asec1606.html). A certified policy with an expiration date is treated as terminated on that date unless it was canceled or replaced earlier.

If the required proof stops being in force, you can remain subject to suspension or other BMV action until acceptable proof is filed again. The safest approach is to line up replacement coverage before any cancellation or expiration date and to keep payments current. If you get a cancellation notice, contact the [BMV Financial Responsibility section (opens in a new tab)](https://www.maine.gov/sos/bmv/driver-licenses-and-ids/license-suspended/financial-responsibility) right away and ask what filing and reinstatement steps apply to you.

[Switching insurers](https://riskado.com/how-to-switch-car-insurance/) works the same way. Have the new policy and filing in place before the old one ends, so there is no gap.

![A wall calendar with two dates circled beside a desk with car keys and an insurance folder](https://riskado.com/blog/maine-sr22-insurance/no-gap.jpg)

Line up the new policy and filing before the old one ends so there is no gap.

## Moving to or from Maine with an SR-22

If your Maine license is suspended pending an SR-22 and you are trying to get a license in another state, the insurer in that other state must also be licensed to do business in Maine, according to the [Maine Bureau of Insurance (opens in a new tab)](https://www1.maine.gov/pfr/insurance/frequently-asked-questions/auto-insurance).

A certified policy is effective only if the company is authorized to do business in Maine, or in the state where the vehicle is registered, or for an operator's policy, the state where the operator lives, under [29-A M.R.S. § 1606 (opens in a new tab)](https://www.legislature.maine.gov/legis/statutes/29-A/title29-Asec1606.html). If you are moving into Maine with an out-of-state filing, give your BMV notice to the insurer and confirm with the Maine BMV that the filing will be accepted.

## Other ways to prove financial responsibility

An insurer's SR-22 is the usual route, but [29-A M.R.S. § 1605 (opens in a new tab)](https://legisweb0.legislature.maine.gov/legis/statutes/29-A/title29-Asec1605.html) allows three methods:

- A certificate from an insurance or surety company.
- A deposit of money or securities with the state.
- For a qualifying transmission and distribution utility, showing financial ability to comply.

A deposit requires a Treasurer of State receipt for an approved deposit equal to the amount a policy would require, evidence that you have no unsatisfied judgments registered in Maine Superior Court, and a certificate of compliance from the Secretary of State. That certificate lasts no more than one year at a time, and the deposit can be held for at least six years after cancellation or for the applicable statute of limitations.

## How an SR-22 affects your premium

Maine law does not set an SR-22 surcharge. Insurers set their own premiums using rates filed with and approved by the Bureau, and the events that led to the SR-22 can affect your price. Driving record, accidents and convictions, prior insurance, where the car is kept, how it is used, the type of vehicle, household drivers, claims and [credit history](https://riskado.com/does-credit-score-affect-car-insurance/) can all affect eligibility or premium, according to the [Maine Bureau of Insurance (opens in a new tab)](https://www.maine.gov/pfr/insurance/consumers/auto-insurance/factors-affecting-your-premium). Ask the insurer or producer to explain which factors drive your quote.

## How to verify an agent or file a complaint

You can confirm a producer or insurer's license by name, license number or identification number through the [Maine Bureau of Insurance Licensee Search (opens in a new tab)](https://www.maine.gov/pfr/insurance/node/3). Contact the Bureau if you need formal confirmation.

Complaints about an auto insurer or producer go through the Bureau's [property and casualty complaint form (opens in a new tab)](https://www.maine.gov/pfr/insurance/consumers/file-a-complaint-dispute/property-casualty-complaint-form). Describe what happened, who was involved, why you believe the company or producer is wrong, what you have done to resolve it and the result you want, and attach copies of your documents. Licensed companies and producers generally must respond within 10 business days plus mailing time, though extensions can happen, according to the [Bureau's complaint page (opens in a new tab)](https://www.maine.gov/pfr/insurance/consumers/file-a-complaint-dispute).

## Questions to ask your agent

- Will your company file the SR-22 directly with the Maine BMV, and is the insurer licensed in Maine?
- What effective date will the filing show?
- What type of policy are you issuing, and is a non-owner policy available if I do not own a car?
- What coverage does my BMV demand require, and which optional coverages are included?
- What happens if a payment is late, and what notice will I get before cancellation or nonrenewal?
- What separate insurer or policy fees apply?
- What documents will I receive, and how can I confirm the BMV accepted the filing?
- Who should I contact if the filing is rejected or delayed?

## Maine SR-22: quick answers

**Does an OUI always require an SR-22 in Maine?** A repeat OUI conviction within 10 years requires proof of financial responsibility before reinstatement under [29-A M.R.S. § 1603 (opens in a new tab)](https://www.legislature.maine.gov/legis/statutes/29-A/title29-Asec1603.html). Other OUI situations can involve separate suspension rules, so your BMV notice is the place to confirm.

**Can I change insurance companies while I have an SR-22?** Yes, as long as the new insurer files its certificate before the old policy ends. Because a certified policy cannot be canceled until 10 days after notice is filed with the Secretary of State, ask both insurers to coordinate dates so the filing has no gap.

**When can the BMV drop the SR-22 demand?** The Secretary of State may waive the demand after three years from the date proof was demanded, under [29-A M.R.S. § 1603 (opens in a new tab)](https://www.legislature.maine.gov/legis/statutes/29-A/title29-Asec1603.html). Confirm with the BMV before you cancel the filing.

**What should I keep while the filing is active?** Keep copies of the policy, the SR-22 certificate, your BMV notice, payment receipts and any letters from your insurer. They make it faster to resolve a rejected filing or a disputed date.

## Your next step

Find your BMV notice, note the effective date, and take it to a [licensed Maine producer](https://riskado.com/agencies/maine/). Once the insurer files the certificate and you have paid the BMV fees, confirm your reinstatement with the BMV before you drive, and keep the policy active until the BMV confirms your requirement has ended.
