Terms of use

These terms apply when you use riskado.com, in English or Spanish. By using the site, you agree to them. If you do not agree, please do not use the site.

Who we are

Riskado is an independent insurance information site and a directory of insurance agencies, both independent agencies and captive offices, across the United States, added state by state. The site is operated by Riskado, based in Harris County, Texas. "We", "us" and "our" mean Riskado, the operator of riskado.com; "you" means anyone who uses the site.

What Riskado is and is not

Riskado publishes general information about insurance and lists agencies. It is not an insurer, agency, broker or producer and holds no insurance license. It does not sell, solicit, negotiate, quote, bind or recommend insurance, and it does not discuss the terms of a specific policy with anyone. The disclaimer has the short version.

  • Articles are general education. They explain terms, rules and questions to ask. They are not advice about your policy, your property or your business, and they are not legal, tax or financial advice.
  • The insurer and the licensed agent set the terms. Coverage, prices, eligibility and claims decisions come from the insurer and the agent who sells the policy. Read the policy itself, and check licensing and questions about a policy with a licensed producer and your state insurance department.
  • Rules and prices change. Laws, forms and rates are updated, sometimes without notice. Confirm any detail you plan to rely on with the agency, the insurer or the state insurance department that sets it.

If you find a fact that has changed, tell us through the contact form.

The agency directory

The directory lists insurance agencies with details such as name, address, phone, website and hours. Each listing is information for you to follow up on. It is not an endorsement, a recommendation or a check of an agency's licenses, appointments, coverage or prices. Riskado does not verify any of those unless the listing says it did, and then it names the source and the date.

Any agreement you make with an agency is between you and that agency. Ask the agency which insurers it works with, what a policy costs and what it covers before you decide. Carrier names and logos belong to their owners and appear only to identify a company; no affiliation is implied.

Listing details come from public business information and agencies' own websites, plus what agencies send us.

A business can ask us to correct or remove its listing through the contact form, sending the listing's link, the detail that is wrong and the correct detail from an email address or phone number the business publishes. We respond within 10 business days. We remove a listing when the business asks, unless it is a paid listing still under contract; that listing is handled under the plan terms in "Plans, billing and refunds" below.

Riskado is paid by agencies and not by readers. Agencies can choose paid directory plans, Pro and Sponsored, for flat monthly or yearly fees for advertising and presentation. The fee never depends on inquiries, clicks, quotes, policies sold or commissions. Sponsored listings carry the label "Sponsored" on the listing. A paid plan is not an endorsement.

Riskado also sells web-marketing services to agencies, such as web design, SEO, review management and video marketing. The affiliate and advertising disclosure explains how the site is paid and what happens if an affiliate link is added.

For agencies

If you list an agency or buy a plan, you confirm that:

  • the information and any content you supply are accurate, current and yours to give us;
  • every license you claim is held and in good standing, and your advertising follows the rules of each state where you operate;
  • you answer for the copy and images you supply, including any carrier names or logos, and have any approval the carrier requires;
  • a paid plan buys advertising and presentation, and Riskado promises no inquiries, customers, quotes or sales.

Payments are made through Square payment links, and Square handles your card details. We may correct, suspend or remove a listing that breaks these terms or the law.

Claimed listings

An agency owner or employee can claim the agency's listing to keep its details current. If two people claim the same listing, we check both claims against the agency's public details and may ask either person for more proof before we decide. An agency can ask us through the contact form to remove a claimed user who no longer works there. If a paid plan lapses, the claim stays in place and the listing returns to the free level.

Plans, billing and refunds

Riskado offers two paid plans for agencies:

  • Pro: $39 a month or $390 a year.
  • Sponsored: $79 a month or $790 a year.

Plans are paid through Square payment links. A plan renews for the same period, monthly or yearly, unless you cancel it.

  • Founding rate. An agency keeps the rate it signed up at for 2 years from the date it signs up. After that, the plan renews at the price then in effect. We give notice before any price change applies to your plan.
  • Monthly plans. You can cancel at any time. The plan ends at the end of the month you have paid for, and there are no refunds for part of a month.
  • Yearly plans. If you cancel a yearly plan early, we refund it pro rata. Each month you used is charged at the full monthly price, not the lower yearly rate, and we refund the rest of what you paid. The refund is never more than the amount you paid, and if nothing is left after the months used, no refund is due. For example, if you cancel a Pro yearly plan of $390 after 4 months, the refund is $390 minus 4 times $39, which is $234.
  • Suspended or removed listings. If we suspend or remove a paid listing because it breaks these terms, the same pro rata rule applies to any fees paid in advance, unless the listing was removed for fraud or impersonation. In that case, prepaid fees are not refunded.

To cancel a plan or ask about billing, write to us through the contact form.

Things you send us

When you send a message, a correction, listing details or, when reviews are available, a review, you confirm that what you send is accurate, that it is yours to send, and that it breaks no law and no one else's rights. You keep ownership of what you send. You give us permission to use it to run the site, and, for a review, to publish it. If you send ideas or suggestions about the site, we may use them without any obligation to you.

Please do not send health details, Social Security numbers, policy numbers, claim details or bank account numbers through the contact form. Questions about a specific policy or claim belong with your agent or insurer.

Rules for using the site

When you use the site, you agree not to:

  • break any law, or help anyone else break one;
  • send false or misleading information, or pretend to be someone else, including falsely speaking for an agency in the directory;
  • send spam, malware or anything harmful through a form;
  • copy, scrape or harvest the site or its directory in bulk by automated means, except for search engines indexing public pages under the robots.txt file;
  • use the site's content to train or build artificial intelligence models or datasets without our written permission;
  • try to get around security features, disrupt the site or overload it; or
  • harass, threaten or defame anyone, including agencies in the directory.

Reading, quoting and linking to pages is allowed with attribution to Riskado. That includes the plain-text copies of pages offered for AI tools at /llms.txt and the .md versions of pages. Bulk copying of the directory data is not allowed.

We may block access, remove material or refuse service to anyone who breaks these rules.

Our content and trademarks

The site's text, data compilations, design, graphics, photos and code belong to Riskado or to those who licensed them to us, and are protected by copyright and other laws. You may read, print and share single pages for your own personal use, as long as you keep our name and any copyright notice, and you may link to any public page. For any other use, such as republishing an article, ask us first through the contact form.

Riskado and its logo are our marks; please do not use them in a way that suggests we endorse you or your business. Other names and logos on the site belong to their owners.

If you believe material on the site infringes your copyright, send a notice through the contact form, addressed to Riskado's copyright agent, or to the email address in the privacy policy. The copyright page lists what a notice needs. The notice should identify the work, the page where the material appears, your contact details, a statement that you believe in good faith the use is not authorized, a statement that your notice is accurate and that you are the owner or authorized to act for the owner, and your signature. We will review it and remove material that infringes.

The site links to state insurance departments, agencies' own websites, insurers and other sources. We do not control those websites and are not responsible for their content, products, privacy practices or availability.

Disclaimer of warranties

We provide the site and everything on it "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy and completeness, and any warranty that the site will be uninterrupted, secure or free of errors. Some places do not allow certain warranties to be excluded, so some of these exclusions may not apply to you.

Limitation of liability

To the fullest extent the law allows, Riskado and its owner, contractors and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from or related to the site. That includes a coverage decision, a denied or delayed claim, a changed price, a missed deadline or a problem with an agency or insurer found through the directory.

To the fullest extent the law allows, our total liability for all claims related to the site is limited to the amount you paid us in the 12 months before the claim arose. Some places do not allow these limits, so some may not apply to you. Nothing in these terms limits liability that the law does not allow to be limited.

Indemnity

To the extent the law allows, you agree to defend and hold harmless Riskado and its owner, contractors and agents from claims, losses and costs, including reasonable attorneys' fees, arising from your breach of these terms, what you send us or your misuse of the site or of directory information.

Changes to these terms

We may update these terms as the site changes and will change the date on the page each time. If you keep using the site after a change, the updated terms apply.

General terms

If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a part of these terms, we have not given up the right to enforce it later. These terms, with the privacy policy and the cookie policy, are the whole agreement between you and us about the site. Web-marketing services sold to agencies may carry their own written terms.

Disputes and arbitration

If you have a concern about the site, please tell us first through the contact form so we can try to resolve it. If we cannot, you and Riskado agree that any dispute about the site, these terms or a paid plan will be resolved by binding arbitration on an individual basis, not in court. The arbitration is seated in Harris County, Texas, and is run under the rules of a recognized arbitration provider. An arbitrator, not a judge or jury, decides the dispute, and court review of an award is limited.

  • No class actions. You and Riskado each bring claims only for yourselves, not as a plaintiff or class member in a class, collective or representative action. An arbitrator may not combine the claims of more than one person.
  • Small claims court. Either side may instead bring an individual claim in small claims court, as long as the claim qualifies there and stays there.
  • Opting out. You can opt out of this arbitration agreement by writing to us through the contact form within 30 days of the day you first use the site. Start your message with "Arbitration opt-out" and include your name. If you opt out, the rest of these terms still apply, and disputes go to the courts named below.

If the class action waiver cannot be enforced for a claim, that claim is heard in court, not in arbitration.

Governing law and contact

These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any matter that is not subject to arbitration, and any action to enforce an arbitration award, is heard in the state or federal courts located in Harris County, Texas, unless the law where you live gives you the right to bring it elsewhere.

Questions about these terms can go through the contact form. These terms are also available in Spanish. If the two versions differ, the English version controls.
